CHECKERED LIFE PHOTOGRAPHY

TERMS OF SERVICE

Effective Date: January 1, 2026

By purchasing, downloading, viewing, sharing, or using photographs from Checkered Life Photography, you acknowledge that you have read, understood, and agreed to these Terms of Service.

1. COPYRIGHT OWNERSHIP

All photographs created by Checkered Life Photography remain the exclusive intellectual property of Checkered Life Photography and are protected under United States Copyright Law.

The purchase of digital images, prints, or other products grants usage rights only and does not transfer copyright ownership.

2. PERSONAL USE LICENSE

Purchased images include a non-exclusive, non-transferable license for personal use, including:

• Printing photographs for personal display.

• Creating albums, scrapbooks, and keepsakes.

• Sharing photographs on personal social media accounts.

• Sharing photographs with family and friends.

3. SOCIAL MEDIA SHARING

Drivers, teams, sponsors, family members, and purchasers may share purchased images online for personal promotional purposes.

Credit to Checkered Life Photography is appreciated whenever possible.

Images may not be altered, heavily edited, filtered, manipulated, or have watermarks removed without prior written permission.

4. COMMERCIAL USE

Commercial use of any photograph is prohibited without written permission from Checkered Life Photography.

Commercial use includes, but is not limited to:

• Advertising

• Merchandise

• Product sales

• Business marketing

• Sponsor advertisements

• Paid promotions

• Publications

Commercial licensing may be arranged separately.

5. PAYMENT

Payment in full is required before delivery of digital files unless otherwise agreed upon in writing.

All sales are final.

6. IMAGE DELIVERY

Checkered Life Photography will make every reasonable effort to deliver purchased images in a timely manner.

Delivery times may vary due to event schedules, weather conditions, equipment issues, illness, travel, internet availability, or other unforeseen circumstances.

7. REFUNDS

Due to the digital nature of photography products, all sales are final and non-refundable once images have been delivered.

8. IMAGE QUALITY

Checkered Life Photography strives to provide the highest quality images possible.

Image quality may be affected by conditions beyond the photographer’s control, including but not limited to:

• Weather conditions

• Lighting conditions

• Track layout

• Safety barriers

• Fencing

• Dust or debris

• Vehicle positioning

• Actions of participants or spectators

No guarantee is made regarding the capture of any specific moment, driver, pass, race result, or event occurrence.

9. MOTORSPORTS EVENT PHOTOGRAPHY

Motorsports events are public events.

The purchaser acknowledges and agrees that photographs may contain spectators, crew members, officials, sponsors, track signage, race vehicles, team members, vendors, and other participants who may appear in the background or foreground of an image.

Checkered Life Photography shall not be responsible for incidental appearances of individuals, logos, vehicles, or event-related materials captured during normal event coverage.

10. MODEL RELEASE

Unless otherwise requested in writing, purchasers grant Checkered Life Photography permission to use photographs for:

• Portfolio display

• Website galleries

• Social media

• Advertising

• Marketing materials

• Photography competitions

• Promotional purposes

No additional compensation shall be provided for such use.

11. LIMITATION OF LIABILITY

In the event of equipment failure, memory card corruption, illness, injury, venue restrictions, acts of nature, or circumstances beyond the photographer’s control, liability shall be limited to the amount paid by the client for the affected products or services.

Under no circumstances shall Checkered Life Photography be liable for indirect, incidental, or consequential damages.

12. MODIFICATIONS TO TERMS

Checkered Life Photography reserves the right to update or modify these Terms of Service at any time.

Continued use of photographs or services constitutes acceptance of any revised terms.
